Conditions of Entry

Information on how to enter and corresponding prizes forms part of these Terms and Conditions. Entry into the Seagrass and TheFork Promotion (Promotion) is deemed to be an acceptance of these Terms and Conditions.
The Promotion commences on 1st August 2023, at 9:00 AM AEST and entries close at 31st August 2023, at 11:59 PM AEST on (Promotion Period).
The Promotion is opened to users of TheFork AU’s website at URL: www.thefork.com.au and TheFork App who are residents of New South Wales, Victoria, Queensland, South Australia, Perth and Australian Capital Territory in Australia and are aged 18 or over. The Promotion is not available to employees of the Promoter, their immediate families, agents or any third party directly associated with the administration of the Promotion. “Immediate family” means any spouse, parent, natural or adopted child, and sibling (whether natural or adopted by parent), regardless of whether they reside in the same household as the employee.

How to enter:
For a chance to win, you must:
1. Book at any Seagrass venue during the month of August 2023 via www.thefork.com.au or TheFork App and honour this booking, being specified that exceptionally and temporarily, for any booking at any Seagrass venue for a meal on a Monday, a Tuesday or a Wednesday in the month of August 2023 duly honoured, the participant will receive three times the amount of Yums (loyalty points after a reservation on the TheFork website, mobile or app, that is duly honoured and can be converted into a price discount deducted from the bill of a restaurant who is enrolled in the Loyalty Program) that should have been received by the participant. For any booking for a meal on a Thursday, a Friday, a Saturday or a Sunday in the month of August 2023, the participant will receive 200 Yums; This retribution will be provided in two instalments: one third seven days after the date of the meal, and two thirds on September 8th 2023.
  
  For instance, if such venue is tagged as "Double Yums" and at the date of the booking the applicable retribution should be 200 Yums, for a booking for a meal on a Monday, a Tuesday or a Wednesday in the month of August 2023 duly honoured, the participant will receive 600 Yums, 200 seven days after the date of the meal, and 400 on September 8th 2023.
  
  For a sake of clarity, this offer is cumulative to any additional applicable promotion code, unless otherwise specified. For instance, if a Yummy Days Promo code is used, such Yummy Days code provides the allocation of 500 Yums but in the framework of this competition, for a booking for a meal on a Monday, a Tuesday or a Wednesday in the month of August 2023 duly honoured, the participant will receive 1 500 (500x3) Yums, 500 seven days after the date of the meal, and 1 000 on September 8th 2023.

  - the booking must be done in your own name provide all contact details as requested by the Promoter; and
  
  - ensure that all details included with the entry (including the participant’s account details on TheFork AU’s App and website) are true and accurate.
An entrant can enter more than once, but each entry must meet all applicable criteria set out in point 5. Each booking honoured in these conditions is an “Entry”. For a sake of clarity, each Entry shall only be counted once; duplicates will be void and removed.
Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
The use of automated entry software, mechanical or electronic devices that allow an individual to automatically enter the Promotion is prohibited and may render all such entries void.
This is a game of chance and skill plays no part. The winners will be chosen by manual random (printed entry form drawn from a container) draw supervised by an independent person at Level 5, 219-241 Cleveland Street, Strawberry Hills, NSW, 2012, Australia at 3:00 PM on 13th September 2023. The ten first valid entries drawn will win the Book & Dine prize. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is awarded the prize.

Winners and prize
The Book & Dine prize consists of a $300 dining voucher to use at any of the following Seagrass venues: 6HEAD, Meat & Wine Co, Hunter & Barrel and Italian Street Kitchen.
There will be ten (10) winners.
Winners will be notified by email on 13th September 2023 to their nominated email address either associated with their TheFork website or App account or used to make their booking via the TheFork website or App and the winners’ name will be published on https://www.thefork.com.au/blog/seagrass-thefork-terms. If participants object to their name and winning entry being published or made available, they should contact the Promoter at @email with a copy to @email. In such circumstances, the Promoter must still provide the information and winning entry to Ad Standards on request.
Winners must claim their prize within twenty-four (24) hours of the Promoter’s communication. If the winners do not claim their prize within twenty-four (24) hours of the Promoter’s communication, their prize will be forfeited and the winners for the unclaimed prize will be determined pursuant to these Terms and Conditions.
The Promoter may conduct such further draws at Level 5, 219-241 Cleveland Street, Strawberry Hills, NSW, 2012, Australia as are necessary on 3rd October 2023 for the unclaimed prizes, subject however to any directions given by any applicable gaming authorities (if applicable). The winners of the unclaimed prize will be notified by email to their nominated email address either associated with their TheFork website or App account or used to make their booking via the TheFork website or App and the winners of the unclaimed prizes will be published on https://www.thefork.com.au/blog/seagrass-thefork-terms.
Winners will be sent instructions as to how to claim and redeem their prize. While the Promotion is open to all eligible residents of New South Wales, Victoria, Queensland, South Australia, Perth and Australian Capital Territory as set out in the “Conditions of Entry” section above, the prize may only be redeemable at the restaurants listed above. The prize do not include flights, accommodation or any other costs associated with redeeming the prize. Any travel and accommodations costs and are at the expense of the winners.
Prize must be redeemed within [three years (3) years] of receipt of prize details. Any prizes not redeemed in that period will be forfeited without reselection.
Prizes for the winners are non-exchangeable, non-transferable, and cannot be sold or exchanged for cash.

General
The Promoter of this Promotion is Dimmi Pty Ltd (trading as TheFork AU) ABN 49 135 408 927, the registered office of which is at Level 5, 219-241 Cleveland Street, Strawberry Hills, NSW, 2012, Australia.
The decision of the Promoter regarding any aspect of the Promotion, including any dispute, is final and binding and no correspondence will be entered into about it.
Participants are deemed to have accepted and agreed to be bound by these Terms and Conditions upon entry. The Promoter reserves the right to refuse entry, or refuse to award the prize, to anyone who is in breach of these Terms and Conditions.
If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the Promotion including the prize and these Terms and Conditions, subject any approval of the gaming authorities in each State and Territory (if applicable).
Personal information supplied during the course of this promotion will only be processed as set out in the Promoter's Privacy and Cookie Statement at www.thefork.com.au/legal. All entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion, announce the winners and disclose the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winners, and to third parties as required by law (including authorities that regulate this Promotion). An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
The Promoter and its agents will not be liable for any injury, loss or damage of any nature whatsoever (including, but not limited to, indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.
If any act or omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these Terms and Conditions, the Promoter will not be liable for any failure to perform or delay in performing its obligation and the Promoter reserves the right (subject to any applicable law) to cancel, terminate, modify or suspend the Promotion.
This Promotion is governed by the Australian law and entrants to this Promotion submit to the jurisdiction of the courts of New South Wales.
